City Council
(1) HNON opposed the appeal of the HDLC decision of “no recommendation” regarding the nomination of 5 South Roadway, West End Lake Shore Park, to the National Register of Historic Places. The appeal was granted by Councilmember Giarrusso.
(2) 2400 Napoleon Avenue—Restoration Tax Abatement—HNON asked (“Info. only”): (1) Whether the Live Entertainment use listed on the abatement paperwork as permitted by right was in fact somehow also the subject of an NPP meeting later that night (which is the prerequisite to a conditional use process); (2) why a Temporary Certificate of Occupancy expired without renewal on Nov. 1; and (3) why no permit was ever filed for a Dec. 11 Christmas theatrical that had been explicitly billed in the NPP letter as permitted. CM Harris declined to answer.
(3) HNON supported the proposed Fairgrounds Overlay, with the proviso that SMFA should be excepted from the legislation—as the affordable housing model has been abused in the University Area; and it is doubtful whether the model can be enforced at all. The motion by Councilman Giarrusso to adopt the Overlay passed unanimously.

Confirmed—Sale of Our Lady of Lourdes Church and School was part of the effort by the Archdiocese to raise money for clergy abuse settlement:
“At a meeting last week at the offices of Jones Walker, which represents the archdiocese in the case, attorneys said some of the money has already been raised from the sale of real estate that belonged to individual parishes or charities, such as the former Our Lady of Lourdes Church on Napoleon Avenue and the former school next store. 2831 Livaudais—Staff Report
In which the developer’s representative complains of the condition of a building the developer has owned for five years…! The ready excuse…the COVID! In the meantime, no minimum maintenance violations have been filed—and there are even some owner-occupants on the same blockface who could have done so…! But on the other hand, the developer has not fulfilled the promises involved in the ill-famed demolition of 5512-5524 Tchoupitoulas last year (2024), which he and his gang—dba Car Wash Blues, LLC—had owned for twelve years as “cynical, negligent property owners operating in bad faith.” So why is one of these fellows entitled to a permit to knock down another historic building? (Oh, the question…!) Anyway, on 11/5/25, good guy Irish Channel Commissioner Greg Hackenberg nixed the full demolition of this bargeboard construction shotgun; and motioned for partial demolition instead, which passed unanimously. We’ll see this one return on us via the City Council on appeal on Dec. 4.

BZA Beat—Kupperman et al. will open an outdoor pool-bar on old Freret over the objections of neighbors. “Sunnies Restaurant” wants an adults-only pool — like the Drifter, only not like the Drifter… And so a large contingent of neighbors lost their zoning appeal against Zach Kupperman, who was supported only by Zach Smith and CNO—which seems to be the same thing these days… HNON says to ZK: “You’re bad…”

ZD 088-24; 900 N. Carrollton, Blue Oak BBQ—conditional use was denied by the CPC, 6–2. Commissioner Kathleen Lunn made the motion at timestamp 1:15:07: “My motion is for denial of the request based on the staff analysis of all of the reasons why they do not meet the hardship requirements for this restaurant to be a more intensified use in that amount of space.” Commissioner Robert Steeg seconded. CPC Staff had recommended approval with four provisos. The matter goes next to the City Council within 120 days. The City Council is not obliged to adopt the recommendation of the CPC. About 10-12 neighbors attended the Oct. 22 CPC hearing to oppose the conditional use.

Town of Carrollton Watch had two BZA appeals on the agenda: (1) 7534 Jeannette (BZA 057-24); and (2) 2831 Calhoun (BZA 058-24). In both matters we were unable to convince the BZA that DSP should observe the law—and therefore concede that “historical use of a bedroom” per CZO Art. 18.30.B.1.a does not apply to unfinished basement spaces or a demolished family room. DSP lied; and BZA let them—with the result that more investors are making more money off of our neighborhoods. A third docket, 7000-7002 Jeannette (BZA 063-24)—a Small Multi-Family Affording housing development that supposedly contains an affordable housing unit—has been deferred until November 18.

The meeting was hosted by Zach Smith Consulting & Design for ZD 093-24, which introduces an “amendment to the text of the Comprehensive Zoning Ordinance to create ‘Ice Manufacturing and Vending Machines’ as principal and accessory uses in all non-residential zoning districts except for the HU-B1A Historic Urban Neighborhood Business District.” (This is the reintroduction of ZD 048-24, which was withdrawn by the City Council on August 22.)
